JURISTS AND POLITICIZATION OF THE JUSTICE IN BRAZIL: ANALYTICAL CHALLENGES FOR THE SOCIOPOLITICAL APPROACH

The analysis of the inter relationships between the spaces of politics and law involves overcoming several assumptions that guide the “legitimate issues” in the political analysis of judicial and institutions agents. On the side of jurists, the claim of a meta-political position for judicial institutions can be highlighted as an obstacle. In political science approaches, one of the problems that deserve to be addressed, involves the intersection and subordination of justice and politics with the logic of the judicial game. Starting from these points, the article seeks to discuss some paths of analysis for the dynamics of the relationship
between the space of judicial institutions and politics in Brazil. The main objective is to try to contribute to a better problematization of this relationship. Above all, to encourage new objects and approaches focused in the social dimension of political-judicial protagonism.
