Abstract

This article calls for reflection on the war on drugs as a racist device for the containment of black bodies in Brazil, carrying out an analytical approach to PEC 45/2023, the so-called “PEC drugs” which has been calling for reflections on state action in the act to imprison. To this end, methodological resources are used: literature review and document analysis. We can observe the paths of the war on drugs through the oppressive hand of the State and government neglect, whether through conviction for drug trafficking, the scrapping of mental health, alcohol and other drugs policy or the approval of PEC 45/2023 that transforms the drug user becomes a criminal, exposing the racist stance of a State that, through the oppression of drug trafficking, kills black and poor people every day.
