Abstract

The research aims to examine the possibility of incorporating ecocide as a crime in the Rome Statute, a treaty that establishes the jurisdiction of the International Criminal Court. Thus, the definition of ecocide is analyzed based on specialized doctrines, providing a retrospective overview of environmental protection and the legal consequences of its
devastation. The foundations of ecopolitics are examined, along with concepts such as Global Governance and Risk Society, in light of the declaration of an unconstitutional state of environmental affairs in Brazil due to deforestation in the Amazon Rainforest. The research method employed was inductive through bibliographic analysis. In conclusion, it was determined
that there is a significant global demand for the criminalization of ecocide given the ineffectiveness of civil-environmental
mechanisms.
