HIGHER EDUCATION IN BRAZIL: the impact of the “Spending Cap” on the federal universities’ budget

This article aims to analyze the impact of the Constitutional Amendment n.95/2016 in the budget of the Federal Universities of Brazil. Based on this purpose, it used the characterization of education as a fundamental right of the individual, from the Federal Constitution of 1988 and other legislative norms that address the responsibility of
the State in funding higher education to the population. The result found in this research shows the need for budgetary recomposition of the Federal Universities, both in the face of the scenario of financial insufficiency to basic funding, but also by the loss of purchasing power caused by inflationary pressure, considering that education is an
important promoter of social welfare and able to reduce inequalities.
